CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION RETURN CONDITIONS

GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation (OG:23.12.2019/30987) and other applicable laws regarding the sale and delivery of the product they purchase.

  3. Shipping costs, which are product shipment costs, will be paid by the buyers.

  4. Each product purchased is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the qualifications specified in the order, and with documents such as a warranty certificate and user manual, if any.

  6. If it becomes impossible to sell the purchased product, the seller is obliged to notify the buyer of this situation in writing within 3 days from the date of learning of this situation. The total price must be returned to the Buyer within 14 days.

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

  1. If the Buyer does not pay the price of the product purchased or cancels it in the bank records, the Seller’s obligation to deliver the product ends.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If, after the product is delivered, it is determined that the credit card used by the buyer for payment was used unfairly by unauthorized persons and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer shall return the product subject to the contract to the SELLER within 3 days, with the shipping costs to be borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If force majeure events occur that the Seller cannot foresee and the product cannot be delivered on time, the Buyer is notified of the situation. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; If the payment is made in cash, this fee will be paid to him in cash within 14 days of the cancellation. If the Buyer makes the payment by credit card and cancels it, the product price will be returned to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer’s account within 2-3 weeks.

BUYER’S OBLIGATION TO CHECK THE PRODUCT:

  1. The Buyer shall inspect the goods/services subject to the contract before receiving delivery; Damaged and defective goods/services such as crushed, broken, torn packaging etc. will not be accepted from the cargo company. It will be accepted that the delivered goods/services are undamaged and intact. The BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services should not be used. The Invoice must be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right of withdrawal from the contract by refusing the goods without assuming any legal and criminal liability and without giving any reason, within 14 (fourteen) days from the date of delivery of the product purchased to him/her or to the person/organization at the address indicated, provided that he/she notifies the SELLER through the following contact information.

PERIOD OF RIGHT OF WITHDRAWAL:

  1. If the Buyer purchases a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the consent of the consumer before the expiry of the right of withdrawal period.

  2. The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.

  3. In order to exercise the right of withdrawal, a written notification must be made to the SELLER by registered mail with return receipt, fax or e-mail within 14 (fourteen) days and the product must not have been used within the framework of the provisions of “Products for which the Right of Withdrawal Cannot be Exercised” regulated in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

  1. Invoice of the product delivered to a 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning it. Order returns invoiced on behalf of institutions cannot be completed if a RETURN INVOICE is not issued.)

  2. The return form, the box of the products to be returned, the packaging and, if any, the standard accessories must be delivered completely and undamaged.

RETURN CONDITIONS:

  1. The SELLER is obliged to return the total price and the documents that put the BUYER in debt to the BUYER within 10 days at the latest from the date the withdrawal notification reaches him/her and to receive the goods back within 20 days.

  2. If there is a decrease in the value of the goods due to a reason arising from the BUYER’s fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER’s damages at the rate of the fault. However, the BUYER is not responsible for the changes and deteriorations caused by the proper use of the goods or product within the right of withdrawal period.

  3. If the campaign limit amount falls below the limit amount arranged by the SELLER due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign will be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Goods that are prepared in line with the BUYER’s request or clearly personal needs and are not suitable for return, make-up materials, disposable products, goods that are in danger of spoiling quickly or whose expiry date is likely to expire, health and hygiene if their packaging is opened by the BUYER after delivery to the BUYER Products that are not suitable for return, products that are mixed with other products after delivery and cannot be separated due to their nature, goods related to periodicals such as newspapers and magazines, other than those provided within the scope of the subscription agreement, services performed instantly in electronic environment or intangible goods delivered to the consumer instantly, It is not possible to return the audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables if their packaging has been opened by the BUYER, as per the Regulation. In addition, it is not possible to use the right of withdrawal regarding the services whose performance has begun with the consent of the consumer before the expiry of the right of withdrawal period, as per the Regulation.

  2. In order for cosmetic and personal care products to be returned, their packaging must be unopened, untested, undamaged and unused.

DEFAULT AND LEGAL CONSEQUENCES

  1. If the BUYER makes the payment transactions with a credit card and defaults, he/she accepts, declares and undertakes that he/she will pay interest within the framework of the credit card agreement between the cardholder and the bank and will be liable to the bank. In this case, the relevant bank may resort to legal remedies; may demand the costs incurred and attorney’s fees from the BUYER and in any case, if the BUYER defaults due to the BUYER’s debt, the BUYER accepts that he/she will pay the damages suffered by the SELLER due to the delayed performance of the debt.
